1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Ashan ("Company," "we," "us," or "our"), governing your access to and use of the Ashan mobile application ("App"), website, and all related services (collectively, the "Services").

By downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

2. Description of Services

Ashan is a specialized AI chatbot application designed to bridge the gap between advanced artificial intelligence and India's diverse linguistic landscape. Our Services include:

• AI-powered chat in 10 Indian regional languages (Hindi, Bengali, Telugu, Marathi, Tamil, Gujarati, Kannada, Malayalam, Punjabi, and Odia).
• Voice-first interaction allowing you to speak with the AI.
• Smart chat management including conversation history and organization.
• Volume-based Sachet subscription plans for affordable access.

3. Account Registration

To use certain features of our Services, you must create an account. By registering, you agree that:

1. All registration information you provide is truthful, accurate, current, and complete.
2. You will maintain and promptly update your registration information to keep it accurate.
3. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
4. You will immediately notify us of any unauthorized use of your account.
5. You must be at least 13 years old to create an account and use our Services.

4. Sachet Subscription & Payments

4.1 Pricing Model

Ashan operates on a volume-based "Sachet" subscription model. You purchase usage credits in small, affordable increments. The specific pricing, credit allotments, and features included in each Sachet plan are displayed within the App and may be updated from time to time.

4.2 Payment & Billing

• All payments are processed through the payment methods available in the App.
• Prices are displayed in Indian Rupees (INR) unless otherwise specified.
• Credits are non-transferable between accounts.
• We reserve the right to modify pricing with reasonable notice. Price changes will not affect credits already purchased.

4.3 Refunds

Due to the nature of digital services, refunds are generally not available for Sachet credits once purchased. Exceptions may apply in cases of technical issues that prevented credit usage, subject to our review.

5. Acceptable Use

You agree to use our Services only for lawful purposes. You shall not:

• Use the Services to generate or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Attempt to reverse-engineer, decompile, or disassemble the App or its underlying AI models.
• Use automated means (bots, scrapers, etc.) to access the Services without our written permission.
• Interfere with or disrupt the integrity or performance of the Services.
• Attempt to gain unauthorized access to other users' accounts or data.
• Use the Services for competitive intelligence or to build a competing product.
• Violate any applicable local, state, national, or international law or regulation.

6. Intellectual Property

All intellectual property rights in the Services, including but not limited to the App, website, source code, databases, functionality, software designs, text, graphics, logos, icons, and AI models, are owned by or licensed to Ashan.

You retain ownership of the content you input into the AI (your prompts and questions). However, you grant us a limited, non-exclusive license to process this content for the purpose of providing and improving our Services.

AI-generated responses are provided for your personal use. You may use AI responses freely, but you acknowledge that similar responses may be generated for other users.

7. AI-Generated Content Disclaimer

Our AI chatbot provides responses generated by artificial intelligence. You acknowledge and agree that:

• AI responses may not always be accurate, complete, or up-to-date.
• AI responses should not be relied upon as professional, legal, medical, financial, or expert advice.
• You are responsible for independently verifying any information provided by the AI.
• We do not guarantee the correctness of AI responses across any language.
• Translation quality may vary between languages and dialects.

8. Voice Chat

By using the voice chat feature, you:

• Consent to the recording and processing of your voice input for AI interaction purposes.
• Acknowledge that voice-to-text conversion may not be perfectly accurate, particularly for regional dialects and accents.
• Agree not to use voice chat to transmit sensitive personal information such as financial details or passwords.

9. Service Availability

We strive to maintain uninterrupted access to our Services but do not guarantee uptime. The Services may be temporarily unavailable due to:

• Scheduled or unscheduled maintenance.
• Technical failures or force majeure events.
• Updates or improvements to our AI models and infrastructure.

We are not liable for any loss or inconvenience caused by temporary service disruptions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Ashan and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, use, goodwill, or other intangible losses.
• Damages arising from your reliance on AI-generated content.
• Damages resulting from unauthorized access to your account.

Our total liability for any claims arising from or related to these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Ashan and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Services ceases immediately. Unused Sachet credits are forfeited upon account termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
